Terms of Service

These Terms of Service ("Terms") outline the rules and regulations for using Amsflow's platform ("We" or "Our" or "Platform" or "Service" or "Amsflow"). By accessing or using the Platform, ("you" or "User") signify your acknowledgment and acceptance of these Terms. The Platform is intended solely for users aged 18 and above. By using our Platform, you represent that you are at least 18 years old and agree to be bound by these Terms. If you disagree with any part of these Terms or are under the age of 18, please do not use our Service.

Limited Warranty

Amsflow endeavors to provide high-quality services. However, our services are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. While we aim for accuracy, efficiency, and reliability, Amsflow does not warrant that the Service will be uninterrupted, timely, secure, or error-free.

We do not guarantee that the Platform will always be available or operate without interruptions. Technical glitches, maintenance, updates, or other factors might occasionally make the Platform inaccessible.

We do not warrant that the Platform will be free from errors, inaccuracies, or defects. Although we make diligent efforts to ensure the accuracy and functionality of our services, it's possible that occasional errors may occur.

We do not guarantee that the Platform will be compatible with all hardware or software which you may use.

Any reliance on the provided Service is at your own risk. In instances where discrepancies or inaccuracies are identified, we appreciate feedback and will endeavor to rectify issues where feasible.

Limited Liability

Under no circumstances shall Amsflow, nor its directors, employees, agents, partners, or suppliers, be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from the use or inability to use the Platform.

Subscription and Refund Policy

Subscriptions to Amsflow provide access to premium features and content. You have the right to cancel your subscription at any time. However, Amsflow operates on a no-refund policy for its subscription services. Any payments made prior to cancellation are non-refundable.

AI credits, whether included with a subscription or purchased separately as one-time top-ups, are non-refundable and have no cash value. AI credits cannot be exchanged for money, transferred to another account, or refunded, in whole or in part, including when a subscription is cancelled, suspended or terminated, or when credits remain unused.

Account Sharing

Each Amsflow account is for use by one individual only. User shall not share, sell, rent, or otherwise make their account, login credentials, or subscription available to any other person, and shall not allow more than one person to access the Platform through the same account. Teams that need access for several people should use a Team plan, which provides a seat for each member.

Account sharing is strictly prohibited. Amsflow may monitor account activity to detect sharing. If Amsflow determines that an account has been shared, the account will be permanently suspended from the Platform without prior notice, and any fees paid, subscriptions and AI credits will be forfeited without refund.

Financial Data Accuracy

Amsflow endeavors to present accurate financial data. However, due to the dynamic nature of financial markets and potential system or human errors, we cannot guarantee 100% accuracy. Users are urged to verify any data before making financial decisions. Amsflow is not liable for any decisions or actions taken based on the information provided on the Platform.

Generative Artificial Intelligence

Certain features of our Platform are powered by Generative Artificial Intelligence (AI) or Large Language Models (LLMs). These AI systems have access to extensive and up-to-date financial data. While Amsflow implements rigorous guidelines and protocols to ensure the highest possible accuracy of AI-generated outputs, User acknowledges and understands the following:

1. Due to the inherent nature of AI and LLMs, features powered by these technologies may occasionally produce inaccurate information or experience hallucinations (generating content that is not factually correct or relevant).

2. Amsflow makes every effort to provide accurate and reliable information through our AI-powered features. However, we cannot guarantee the absolute accuracy or reliability of AI-generated content.

3. User agrees that Amsflow shall not be held responsible or liable for any inaccuracies, errors, or misleading information that may be generated by our AI-powered features.

4. User is advised to exercise due diligence and verify any critical information obtained through AI-powered features before making financial decisions or taking any actions based on such information.

5. By using AI-powered features on our Platform, User acknowledges the potential limitations and risks associated with AI-generated content and agrees to use such features at their own discretion and risk.

Amsflow is committed to continuously improving our AI systems and implementing safeguards to minimize inaccuracies. However, User remains responsible for their use of AI-generated information and any consequences resulting from reliance on such information.

Financial Insights Disclaimer

The insights, information, and data presented on Amsflow ("Platform") are provided for informational purposes only. User understands and agrees to the following:

1. No Financial Advice: The content provided on the Platform does not constitute financial, investment, legal, or tax advice. Amsflow does not offer advisory services or personalized recommendations in any jurisdiction or country. Our sole objective is to provide data and information.

2. No Endorsement: Amsflow does not endorse, promote, or recommend any financial products, stocks, securities, cryptocurrencies, or companies. Any mention of specific financial instruments or entities is for informational purposes only.

3. User Responsibility: Any decisions made based on the information or insights provided through the Platform are solely the responsibility of the User. User should conduct their own research and consult with qualified financial professionals before making any investment or financial decisions.

4. Past Performance: Any references to past performance of financial instruments or markets are not indicative of future results. User should not interpret such information as a guarantee of future performance.

5. Risk Warning: Investing in financial markets involves risk, including the possible loss of principal. User should carefully consider their investment objectives, level of experience, and risk appetite before making any financial decisions.

7. Regulatory Compliance: Amsflow does not guarantee that the information provided complies with the regulations of User's jurisdiction. User is responsible for ensuring their use of the Platform and its information complies with applicable laws and regulations in their jurisdiction.

8. No Fiduciary Relationship: Use of the Platform does not create any fiduciary relationship between User and Amsflow. Amsflow is not acting as a financial advisor, broker-dealer, or in any other fiduciary capacity.

By using the Platform, User acknowledges and agrees to this Financial Insights Disclaimer. If User does not agree with any part of this disclaimer, they should discontinue use of the Platform immediately.

Simulations, Backtesting, Paper Trading and Alerts

The Platform includes tools that simulate trading and investment outcomes, including but not limited to strategy backtesting, Bar Replay, Paper Trading, strategies and indicators written in FlowScript or generated by Flow Agent, portfolio and retirement simulators, financial planning projections, and financial calculators (collectively, "Simulations"), as well as price, technical, conditional and fundamental alerts ("Alerts"). User understands and agrees to the following:

1. Hypothetical Results: Results produced by Simulations are hypothetical. They do not represent actual trading, and no real money, securities, cryptocurrencies or other assets are bought, sold or held. Hypothetical results have inherent limitations: they are prepared with the benefit of hindsight, and no representation is made that any account will or is likely to achieve profits or losses similar to those shown. There are frequently sharp differences between hypothetical results and the actual results subsequently achieved by any particular trading program or strategy.

2. Model Assumptions and Limitations: Simulations rely on simplifying assumptions, including but not limited to order fills at a specific price such as the next bar's open, the commission and costs User enters, and the absence or approximation of slippage, spreads, liquidity, market impact, partial fills, gaps, trading halts, borrowing costs, margin requirements, taxes, dividends and corporate actions. Simulations cannot account for the financial risk and emotional pressure of actual trading. Results may change when the underlying data, its history, the timeframe, the date range, the settings or the Platform's calculations change.

3. Data Limitations: Simulations use historical and real-time market data that may be incomplete, delayed, adjusted, revised or inaccurate, and that may not reflect prices at which trades could actually have been executed. Historical data may be affected by survivorship bias, splits, dividend adjustments and the limited history available for a given symbol or plan.

4. Paper Trading: Paper Trading uses a virtual balance with no monetary value that cannot be withdrawn, transferred or exchanged. Simulated orders, fills, leverage, liquidation prices, profits and losses are for practice and educational purposes only and are not an indication of results in a live brokerage account.

5. Strategies, Scripts and AI-Generated Content: Built-in strategies, community scripts, and strategies or indicators written in FlowScript by User or generated by Flow Agent are provided for research and educational purposes only. They are not recommendations, trading signals or advice to buy, sell or hold any instrument, and may contain errors. User is solely responsible for reviewing, testing and validating any strategy, script or AI-generated output before relying on it. Strong backtest results may be the product of overfitting and may not hold in the future.

6. Alerts: Alerts are provided for convenience and informational purposes only. Amsflow does not guarantee that any Alert will be evaluated, triggered or delivered, or that it will be delivered on time, in the correct order or only once. Alerts depend on market data, evaluation schedules, market hours and third-party services such as email, SMS and webhook providers, and may be delayed, missed, duplicated or triggered in error. An Alert is not an order and does not execute any trade. User should not rely on Alerts as the sole means of monitoring positions or managing risk.

7. No Liability: To the maximum extent permitted by applicable law, Amsflow, its directors, employees, agents, partners and suppliers shall not be liable for any loss or damage, including but not limited to trading losses, lost profits or missed opportunities, arising from or related to User's use of or reliance on Simulations, Paper Trading, strategies, scripts, AI-generated content or Alerts, including any Alert that is delayed, not delivered, duplicated or triggered in error.

8. User Responsibility: Before trading with real money, User should understand the risks involved, consider their financial situation and objectives, and consult a qualified financial professional. All trading and investment decisions, and their consequences, are solely User's responsibility.

PAST PERFORMANCE, WHETHER ACTUAL OR SIMULATED, IS NOT NECESSARILY INDICATIVE OF FUTURE RESULTS.

Financial Data Redistribution Policy

User acknowledges that a significant portion of the financial data available on the Amsflow platform is commercially licensed from various sources, including data brokers, exchanges, and regional and global financial institutions. The copyrights to this licensed data are protected by applicable laws.

User agrees not to redistribute any financial data obtained through the Platform for commercial purposes, unless such redistribution is explicitly covered by User's subscription plan or User has acquired a separate redistribution license from Amsflow.

Amsflow shall not be held liable for any unauthorized or illegal redistribution of licensed financial content for commercial purposes that occurs through the Platform. User assumes full responsibility for ensuring compliance with this policy and any applicable data usage laws.

Fair Usage Policy

To ensure the stability, security, and optimal performance of our Platform for all Users, Amsflow implements a Fair Usage Policy. User agrees to adhere to the following guidelines:

1. User shall not engage in any activities that may overwhelm or disrupt our systems, including but not limited to Distributed Denial of Service (DDoS) attacks, execution of harmful scripts, or running automated bots for scraping purposes.

2. User shall not attempt to gain unauthorized access to any part of the Platform, other User accounts, or any systems or networks connected to the Platform.

3. User shall not use the Platform in any manner that could damage, disable, overburden, or impair our servers or networks, or interfere with any other party's use and enjoyment of the Platform.

4. User shall not attempt to probe, scan, or test the vulnerability of the Platform or any associated system or network, or breach any security or authentication measures.

5. User shall not collect or harvest any information from the Platform, including User data or financial information, unless explicitly authorized by Amsflow.

6. User shall not use any deep-link, page-scrape, robot, spider, or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Platform.

Amsflow reserves the right to monitor Platform usage and take appropriate action, including but not limited to warning, suspending, or terminating User access, in cases of violation of this Fair Usage Policy. Amsflow may also pursue legal action in severe cases of policy violation.

Modifications to the Terms

Amsflow reserves the right to change, modify, or revise these Terms at any time. Users are encouraged to periodically review these Terms. Your continued usage of the Platform post any modifications signifies your acceptance of the revised Terms.

Termination

Amsflow reserves the right to suspend or terminate users who violate these Terms or pose a risk to the integrity or security of our Platform.
